2. What Personal Information do we collect?

When you sign up for one of our Services, purchase and/or register a domain name, use one of our Services; and/or when you contact us directly through any communication channel (for example, Wix support tickets and emails), you provide us with Personal Information, such as your name, email address, telephone number, certain Personal Information relating to payment (for Users of Paid Services), certain Personal Information that you include in your communications with us, and certain Personal Information contained in scanned identification documents (such as an identity card , driver's license, passport or official company registration documents).

2. Information We Collect When You Use the Services. When you visit, download and/or use one of our Services, we may collect aggregate Personal Information about how it is used, such as visitor and user browsing and click-stream activity on the Services, session hotspot and scroll maps, Non-Personally Identifiable Information regarding the Visitor's or User's device, operating system, internet browser, screen resolution, settings language and keyboard, ISP, referring/exit pages, timestamp, etc.

3. Information We Collect from Other Sources. We may receive Personal Information about you from third-party sources, such as i) security service providers and fraud detection or prevention service providers, for example to help us screen out users associated with fraud, or ii) social media  platforms. When you log in or register using your social media account, we may receive Personal Information from that service (for example, your user name and your basic profile Personal Information) and, in some cases, we may collect Personal Information from specialized companies that help us improve our service offering; iii) advertising and marketing partners who track, manage and measure our advertising campaigns.

3. To provide our Users with ongoing customer and technical support

4. To be able to contact our Users with general or personalized service-related promotional messages and notices (as described at dans section 8 below)

5. To help us update, expand and analyze our records to identify new customers;

6. To facilitate, sponsor and deliver certain contests, events and promotions, determine entrant eligibility, track performance, contact winners and award prizes or benefits;

7. To create aggregated statistical data and other aggregated and/or inferred Personal Information, which we or our business partners may use to provide and improve our respective services;

8. To provide you with professional assistance, only at your request;

9. To enhance our data security and fraud prevention capabilities; And

10. To comply with applicable laws and regulations.

1. The use of your Personal Information is necessary to perform a contract or take steps to enter into a contract with you (for example, to provide you with a website developer and to provide you with our customer or technical support)

Wix may share the following categories of Personal Information with Third Party Service Providers for marketing purposes:

• Identifiers, including name, alias, mailing address, unique personal identifier (PIN), online identifier, internet protocol address, email address, account or other similar identifiers

• Commercial Personal Information, for example Personal Information regarding products or services purchased, obtained or considered.

Wix is responsible for Personal Information it receives under the Privacy Shield and then transfers to a third party as described in the Privacy Shield Principles. In particular, Wix remains liable under the Privacy Shield Principles if a Third Party Service Provider processes Personal Information on its behalf in a manner inconsistent with those principles, unless Wix demonstrates that it is not responsible for the event causing the damage.

4.3.

Social Media Features and Framed Pages: Our Services include certain social media features, widgets and unique identifier features, such as "Facebook Connect", "Google Sign-in", "Facebook Like" or "Share this" buttons. and other interactive mini-programs (the “Social Media Features”). These Social Media Features may collect certain Personal Information, such as your IP address or the page you are visiting on our Website, and may set a Cookie to enable them to function properly. Social Media Features are either hosted by a third party or hosted directly on our Services. Your interactions with the Social Media Features of these third parties are governed by their policies and not ours.

In addition, our Services may allow you to share your Personal Information directly with third parties, for example through framed page techniques to deliver content to or from Third Party Service Providers or other parties, while preserving the look and feel of our Website and Services (the "Frames"). Please be aware that if you choose to interact with or share Personal Information through such Frameworks, you are in fact providing it to such third parties and not to us, and such interactions and sharing are governed by the policies of such third parties and not by ours.

4.4.

App Market Developers: As part of our App Market program, we allow third party developers (“Third Party Developers”) to develop and offer their own applications through the Wix App Market (“App(s) third party(ies)”), in association with Wix.

Each Third Party Developer is bound by agreement App Market Wix - Partner Program Agreement  which contains, among other things, restrictions on how it can access Personal Information that you and/or your Users provide to them or that we provide to them (as further explained in _cc781905-5cde -3194-bb3b-136bad5cf58d_Wix App Marketplace Terms of Service), store, share and use them

We encourage you to review the privacy policy accompanying each Third Party Application and ask the Third Party Developers for any clarifications you may need before deciding to install and use their Third Party Application. Wix does not control and is not responsible for the actions or policies of Third Party Developers, and you use any Third Party Application at your own risk.

It is entirely your responsibility to inform your Users of the collection, processing and use of their Information and to inform them that their Information will be transferred to and processed by Wix on your behalf.

4.5.

Wix Subsidiaries and Affiliates: We may share your Personal Information internally within our group of companies, for the purposes described in this Privacy Policy. For example, we may share your Personal Information with Wix.com Inc., our US-based subsidiary, in connection with facilitating and providing our services to you and your Users.

The sharing of Personal Information of Wix subsidiaries and affiliates of Wix in the European Union and Switzerland with the US subsidiary of Wix complies with the EU-US and Swiss-US Privacy Shield Frameworks.

4.6.

In the event of a change of control of a company: In addition, if Wix or any of its affiliates were to undergo a change of control, including through a merger, acquisition or purchase of a substantial part of its assets, your Personal Information may be shared with relevant parties.

Upon Your Instructions: Wix may also share your Personal Information with third parties for other purposes at your direction or with your explicit consent.

5. Where do we store your Personal Information?

Personal Information of Users and their Users may be stored in data centers located in the United States of America, Ireland, South Korea, Taiwan and Israel. We may use other countries if necessary for the proper provision of our Services and/or if required by law (as explained in more detail below).

Wix.com Ltd. is based in Israel, which is considered by the European Commission to provide an adequate level of protection to the Personal Information of residents of EU member states.

Wix Affiliates and Third Party Service Providers that store or process your Personal Information on Wix's behalf are contractually committed to protecting and securing it, consistent with industry standards and regardless of any lesser legal requirements that may arise. apply in their jurisdiction.

Disclosure under the EU-US or Swiss-US Privacy Shield

Wix participates in, and has certified compliance with, the EU-US and Swiss-US Privacy Shield Frameworks. Wix is responsible for the processing of Personal Information it receives under the Privacy Shield Framework, and onward transfers to third parties acting as agents on its behalf. Wix complies with the Privacy Shield Principles for all onward transfers of Personal Information from the EU, including the onward transfer liability provisions.

With respect to Personal Information received or transferred pursuant to the Privacy Shield Framework, Wix is subject to the regulatory enforcement powers of the United States Federal Trade Commission (FTC). In certain situations, Wix may be required to disclose Personal Information in response to a lawful request by public authorities, including to meet national security or law enforcement requirements, and will do so when local privacy laws data permit.

Upon request, Wix will provide you with information telling you whether we hold Personal Information about you. You may access, correct or request deletion of your Personal Information by following the instructions provided in these Help Center articles: “ Recovering Your Wix Account Data ” or “ Permanently Deleting Your Wix Account ”. We will respond to your request within the time required by local law or within a reasonable time.

Please note that permanently deleting your Wix account erases all of your Personal Information from Wix's databases. Once this process is complete, you will no longer be able to use any of your Services, your User Account, all of its data will be permanently deleted, and Wix will no longer be able to restore your account or recover your Personal Information. In this case, if you contact Wix Support, the system will not recognize your account and our customer service agents will not be able to locate the deleted account.

5.2.

Among other things, Wix adheres to the EU-US and Swiss-US Privacy Shield Principles, to better protect the privacy of our Users.

Data Localization Obligations: If you reside in a country that imposes "data localization" or "data residency" obligations (i.e., requires that the Personal Information of its residents be kept within the territorial limits of that country), and this fact becomes known to us, we may keep your Personal Information within these territorial limits, if we are legally obliged to do so.

You agree that by doing so, we may continue to collect, store and use your Personal Information elsewhere, including in the United States of America, as explained above.

5.3.

Some countries require us to maintain and store their residents' Personal Information locally.

We may also collect, process, store and use such Personal Information elsewhere, including in the United States.

6. Personal Information of Users of our Users

Wix may collect, store and process certain Personal Information of Users of our Users (“User Information of our Users”), solely on behalf of and at the direction of our Users. For example, each of our Users is able to import their email contacts from third-party services like Gmail, or collect and manage their contacts through their User Website. These contacts are then stored at Wix on behalf of the User.

To this end, Wix acts as, and is deemed to be, a "Processor" and not the "Controller" (as both of these terms are defined in the General Data Protection Regulation ["GDPR") ] of the European Union) of this information about Users of our Users.

The Users who control and operate these User Websites will be considered the "Controllers" of their Users' Information, and they are responsible for compliance with all laws and regulations that may apply to the collection and control of the Information. of their Users, including all privacy and data protection laws of all applicable countries.

You are responsible for the security, integrity, and authorized use of Users' Personal Information of Users, and for obtaining consents, authorizations, and providing data subject rights and processing notices. fairness required for the collection and use of such Personal Information.

If you are a visitor, User or customer of one of our Users, please read the following: Wix has no direct relationship with the Users of the Users whose Personal Information it processes. If you are a visitor, User or customer of one of our Users, and wish to make a request or request regarding your Personal Information, please contact such User(s) directly. For example, if you wish to request to access, correct, amend or delete inaccurate Personal Information processed by Wix on behalf of its Users, please direct your request to the relevant User (who is the "Controller" of such data ). If a User requests Wix to delete their User's Personal Information, we will respond to such request in a timely manner, after verification and in accordance with applicable law (for example, thirty [30] days under the GDPR). Unless otherwise instructed by our User, we will retain its Users' Personal Information for the period specified in article 12 below.

We and our Third Party Service Providers use cookies and other similar technologies (“Cookies”) to provide our Service and to ensure that it functions properly, to analyze our performance and marketing activities, and to personalize your experience.

​ Please note that permanently deleting your Wix account erases all of your Personal Information from Wix's databases. Once this process is complete, you will no longer be able to use any of your Wix Services, your account and all of its data will be permanently deleted, and Wix will no longer be able to restore your account or recover your data. If you contact one of our support channels after this, the system will not recognize your account and our support agents will not be able to locate the deleted account.

Wix does not and will never sell the Personal Information of your customers (Users of Users).

We are not responsible for requests that are not marked or sent correctly, and we may not be able to respond if you do not provide adequate information. Please note that your request does not guarantee a complete or complete removal of the affected content. For example, materials you have posted may be republished by another user or third party.
